New Hampshire Insurance Department Proposes Legislation to Strengthen Consumer Protections for Medicare Advantage Beneficiaries
CONCORD, NH (December 2, 2024) – The New Hampshire Insurance Department (NHID) is pleased to announce the introduction of a legislative proposal sponsored by State Senator Kevin Avard aimed at strengthening protections for Medicare Advantage beneficiaries. This bill, requested by the NHID, seeks to enhance transparency and accountability by requiring insurance companies to formally notify the Insurance Commissioner at least 120 days in advance of significant changes to or discontinuation of Medicare Advantage plans.
The proposed legislation, which amends RSA 402:84, will ensure that the NHID is equipped to assist impacted individuals in finding alternative coverage options. By mandating timely notification of significant plan modifications or discontinuations, the NHID can work proactively to support affected seniors.
“This bill underscores the Insurance Department’s commitment to safeguarding the well-being of New Hampshire’s seniors,” said Insurance Commissioner DJ Bettencourt. “Timely and transparent communication from insurers is essential to protecting Granite State consumers and ensuring continuity of care.”

The NHID recognizes that protecting New Hampshire’s senior population is a shared priority and looks forward to working closely with the incoming Ayotte Administration to achieve this goal.
The bill addresses critical concerns regarding Medicare Advantage policyholders, ensuring that insurance companies meet their obligations to notify not only the NHID but also affected agents and policyholders within 120 days. This timeline allows seniors to understand their options and secure appropriate coverage without unnecessary disruption.
